COPPA COMPLIANCE NOTICE

ABOUT THIS NOTICE

 

This COPPA Compliance Notice explains how XMA Gym ("we," "our,"

or "us") handles the personal information of children under the

age of 13, in accordance with the Children's Online Privacy

Protection Act (COPPA), 15 U.S.C. § 6501 et seq., and its

implementing regulations issued by the Federal Trade Commission

(FTC).

 

This Notice applies to information collected through our

website, online registration forms, mobile app, and any other

online services we operate.

1. INFORMATION WE COLLECT FROM CHILDREN UNDER 13

 

We do not knowingly collect personal information directly from

children under the age of 13 through our online services

without verifiable parental consent.

 

In connection with youth programs, junior memberships, or

class enrollments for children under 13, we may collect the

following information — provided by a parent or legal guardian:

 

- Child's full name and date of birth

- Parent or guardian's name, address, phone number,

and email address

- Emergency contact information

- Relevant health or medical information necessary

for safe participation

- Payment information (provided by parent/guardian only)

 

We collect only the minimum information necessary to provide

our youth services safely and effectively.

2. HOW WE USE THIS INFORMATION

 

Information collected in connection with children under 13

is used solely for the following purposes:

 

- Enrolling the child in the applicable program or class

- Communicating with the parent or guardian about

scheduling, progress, and program updates

- Ensuring the health and safety of the child during

participation

- Processing payments made by the parent or guardian

- Complying with legal obligations

 

We do not use this information for marketing or advertising

directed at children, and we do not build profiles of

children for commercial purposes.

3. VERIFIABLE PARENTAL CONSENT

 

Before enrolling a child under 13 in any XMA Gym program or

collecting their personal information online, we require

verifiable parental consent. Consent may be obtained through

one or more of the following methods:

 

- A signed physical or electronic consent form completed

by the parent or legal guardian

- A phone call or in-person confirmation with a

parent or guardian

- Any other method that reasonably ensures the person

providing consent is the child's parent or guardian

 

A parent or guardian may withdraw consent at any time by

contacting us using the details in Section 8 of this Notice.

4. DISCLOSURE OF CHILDREN'S INFORMATION

 

We do not sell, rent, or share the personal information of

children under 13 with third parties for commercial or

marketing purposes.

 

We may share this information only in the following limited

circumstances:

 

- With service providers who assist us in delivering youth

programs (e.g., scheduling platforms, payment processors),

who are contractually bound to keep the information

confidential and use it only for the services provided

- With emergency responders when a child's health or safety

is at risk

- When required by law, court order, or government authority

5. PARENTAL RIGHTS

 

Parents and legal guardians have the following rights

regarding their child's personal information:

 

- Review: You may request to review any personal information

we have collected about your child.

- Correction: You may request that we correct inaccurate

personal information from our records, subject to any

legal retention requirements. Please note that deletion

may result in the child being unable to participate in

our programs.

- Withdraw Consent: You may withdraw your consent to our

collection and use of your child's information at any time.

- Refuse Further Collection: You may refuse to permit

further collection or use of your child's information

while still allowing the child to participate where

feasible.

 

To exercise any of these rights, please contact us using the

information in Section 8 of this Notice. We will respond to

all verifiable requests within a reasonable timeframe.

We take the security of children's personal information

seriously. We implement reasonable physical, administrative,

and technical safeguards to protect this information from

unauthorized access, disclosure, alteration, or destruction.

 

Access to children's information is restricted to staff

members who have a legitimate need to access it in order

to provide our services.
